New Variation on Telephone Collection Scam Related to Delinquent Payday Loans
The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.
Callers pose as representatives of the FBI, “Federal Legislative Department,” various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim’s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.
The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim’s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it’s the latter, the caller tells the victim that he or she is wanted for hacking into a business’ computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.
The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim’s job. In another instance, a phony process server came to a victim’s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.
If you are contacted by someone who is trying to collect a debt that you do not owe, you should:
◾Contact your local law enforcement agencies if you feel you are in immediate danger;
◾Contact your bank(s) and credit card companies;
◾Contact the three major credit bureaus and request an alert be put on your file;
◾If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
◾File a complaint at www.IC3.gov.

.Keep getting calls on cell from "unknown" who leaves a recorded message from "Janet Daniels," saying, "I have paperwork ready to serve you with at either your place of employment or residence. If you have any questions you may contact the plaintiff at (888) 390-5398. " Of course the person for whom they are supposedly calling (have you noticed how garbled the name sounds) isn't me. I called back and got the offices of Richard Lacey...hung up.
I've already filed a complaint on the national do not call registry,the FTC and my state attorney generals office. -

I Also was receiving calls from them for three weeks straight on all three of my phone numbers. they said I owed on two payday loans from 2006. Threatened arrest for check fraud. I reported them to my Attorney General. The Attorney General's office called them three or four times and Richard Lacey and Assoc would not provide a physical address and actually got rude to the Attorney General's office and said they were going to press charges against the Attorney General's office. REALLY??? anyway since the Attorney General's office called them they have stopped calling me.

Very disturbing message from Janet Daniels stating I would be served at home or work. Called 888-390-5398, lady told me I owed 2 payday loans from 2006. Then attorney got on the phone asking for $775.00 today with credit card. He was very rude and had the nerve to tell me to have a blessed day. These types of calls can cause heart attacks or strokes and the liars who are behind this will go to hell for this. Totally un called for.

I recieved at call here at my place on employment from a recorded message from Janet Daniels stating that I will be served with paper at my work or my home then the call disconnects.Calling back to the 888-390-5398 first you get a recording stating you can leave your name and number and someone will call you back.After being totally paniced I calle dback there 3 hours later.Got someone on the phone at ext 103 and was total I three differnt loans on line and needed to pay the full amount by end of business day today.Now realize they are on the east coast and Im on the west coast 3 hours time difference.How is it possible that you receive info in the mail from one of the collection agencies that also this Richard Lacey Allies is saying I owe money too. Sounds very fishy too me

Called me on a debt from 2007 and are threating to have me arreseted. I called the attorney generals office they told me to call the compnay back and ask them for a breakdown on what the debt wasy and they told they are not a debt collecter they are an attorney's off and they do not have to give me any information on the debt but the processer and sherrif with arrest warrant would be out today to arrest me. They even represented themselves as attornies.

They called me today stating I owe CashNet USA for an outstanding loan and 2 other companies that they would be serving an arrest warrent when I told Ms Daniels that I already spoke to CashNet USA and that told me they believe this to be a scam she got very upset.

They have been calling me for years stating that I owe money they need to know where to serve me, home or my work place. This is an attempt to scam money because I don't owe on any loans. My husband thought I did one year when they called, paid them and they began calling again the next year. They start off with where can I serve you to scare you into offering money, thats how they scam you.

Keep getting a daily Voice Mail from this number threating to serve papers to a Lindsey Hall..Which of course is not her number..the dude that answers really gets a kick out of it, when you return the call and tell them that they have the wrong number and demand them to take it off their call lists...this person just laughs...

This company calls with harrassing information about funds owed. They will not accept proof or a paid in full letter, which is illegal and threatens to report you to a court system. The copany that they claim to represent is JD Marketing.

Beware, it's a total scam! They called here, claiming that I had committed felony check fraud and threatening me with an arrest warrant that would be issued if I don't pay $140.00 within the next 24 hours. They also asked for personal information that didn't even make any sense to me at all. After a while I just hung up, because it was getting ridiculous! They called again after a few hours asking how I'd like to settle things. I just hung up again and blocked the number. It's a scam, so why bother?!

I got this call last week i called them & left a message they called back left extension 103.I called this am they said we owed them for a on line check not paid said we would be served & were going to put a lean on our home,she said a attorney would call back .I called my attorney & she told me what to tell them told me warrant was being sent hung up on me I CALLED THEM BACK!! Told her don't hang up on me she was trying to talk over me I Told Her To Shut The F--- Up & Listen ! WE Have Never taken out a loan on nothing Then I told that hag if she wanted to play ball I Had The Bat & hung up on her !!! I called our local police ( they all know us we went to school together). They said it was a scam ! Went out for a bit got home they left another msg i called & told them they call me again i will press charges !!!!!!!
